1. Agreement to Terms

By downloading, installing, or using ScanSwift ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and ScanSwift regarding your use of the App.

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial purposes.

2.2 Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose

3. User Responsibilities

• Ensuring you have the right to scan or generate specific codes
• Any actions taken based on scanned information

3.2 Prohibited Activities

You must not use the App to:

• Scan or generate codes for fraudulent, illegal, or harmful purposes
• Violate any third-party rights, including intellectual property rights
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems or networks

4. Intellectual Property Rights

The App and all its content, features, and functionality (including but not limited to software, text, graphics, logos, icons, and images) are owned by ScanSwift and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. App Features and Functionality

5.1 QR Code and Barcode Scanning

ScanSwift provides the ability to scan various types of QR codes and barcodes. While we strive for accuracy, we do not guarantee that all scans will be successful or that the information obtained from scans is accurate or complete.

5.2 Code Generation

The App allows you to generate QR codes and barcodes. You are responsible for ensuring that any codes you generate comply with applicable standards and do not infringe on third-party rights.

5.3 Scan History

The App may store your scan history locally on your device. You can delete this history at any time through the App settings.

By using the App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

7. Updates and Modifications

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of scan results

We do not warrant that the App will meet your requirements or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANSWIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

10. Indemnification

You agree to indemnify, defend, and hold harmless ScanSwift and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any harmful or illegal content you scan or generate using the App

11. Third-Party Services and Links

The App may contain links to third-party websites or services that are not owned or controlled by ScanSwift. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You must delete the App from your device.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration or in the courts of your jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScanSwift regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.
